Terms of Service

1. Acceptance

If you don't agree to these Terms, please don't use our site or services. We may update these Terms from time to time; the version posted here is the one currently in effect.

2. Services Offered

JoyPop LLCprovides custom balloon arrangements, event décor, party supplies, and related services. We reserve the right to refuse, cancel, or modify any order or booking at our discretion (for example, if a request is outside our capacity, unsafe, or violates these Terms).

3. Bookings & Cancellations

A 50% deposit is required to confirm and reserve your event date. Deposits are non-refundablebecause we begin sourcing materials and reserving our team's time as soon as your booking is confirmed.

• Cancellations made 14 or more days before your event may receive a credit toward a future booking, at our discretion.
• Cancellations made within 14 days of the event are not eligible for refund or credit.
• Date changes are subject to availability and must be requested in writing.

4. Pricing & Payment

Prices on the site are estimates. Final pricing is quoted after we review your request and confirm details such as size, color palette, materials, delivery, and on-site labor. Quoted pricing is valid for 14 days unless stated otherwise.

Payment is processed securely through Square. The remaining balance is due before delivery or setup unless we've agreed otherwise in writing. Late or unpaid balances may result in delayed or cancelled service.

5. Delivery & Setup

Delivery fees vary by location and are calculated based on distance from our studio. Setup fees may apply for arches, installations, and large-scale décor. We'll quote these costs before you confirm. You're responsible for providing safe, accessible setup space and any required venue approvals.

6. Custom Designs & Color Matching

We do our best to match the colors, themes, and inspiration photos you share. Because balloon manufacturers update their lineups and colors can vary slightly between batches, exact color matching is not guaranteed. Final designs are also subject to creative interpretation by our team.

7. Weather & Outdoor Events

Balloons are sensitive to heat, direct sunlight, wind, and cold. Latex balloons may expand and pop in high heat and may deflate faster outdoors. We'll advise you on the best placement, but we cannot guarantee the appearance or longevity of balloons displayed outdoors. Damage caused by weather, pets, children, or guests after delivery is not covered.

8. Liability

To the fullest extent permitted by law, our total liability for any claim arising out of an order, booking, or use of the site is limited to the amount you actually paid us for the service or product at issue. We are not liable for indirect, incidental, or consequential damages, including lost profits or missed events.

9. Intellectual Property & Photo Use

All content on this site — including logos, photos, and designs — is owned by JoyPop LLC or used with permission. You may not copy or reuse it without our consent.

We may photograph our work at your event and use those photos in our portfolio, on social media, or in marketing materials. We do our best to keep the focus on the décor itself. If you'd prefer we not photograph your event or use the photos publicly, just let us know in writing at joypopllc@yahoo.com and we'll honor your request.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising out of these Terms or our services will be resolved in the state or federal courts located in North Carolina.
